Purpose of the Job

The Manager: Legal and Discipline supports SAICA’s Legal and Discipline Department by investigating and prosecuting complaints against members, associates, and trainees. The role includes assessing Fit and Proper status, supporting the Designated Disciplinary Officer (DDO) with reporting and statistics, and assisting other department members as needed.

Key Outputs

1. Legal Advice

  • Provide legal advice and draft opinions for SAICA business units.
  • Ensure organizational activities comply with laws and regulations.
  • Deliver professional advice on complex legal and policy issues.
  • Maintain regular engagement with key stakeholders (Training, Education, Risk, Compliance, Examinations).

2. Disciplinary & Litigation Process

  • Respond to internal/external disciplinary queries.
  • Ensure compliance with SAICA’s Constitution and By-Laws.
  • Manage end-to-end disciplinary processes, including committee coordination and correspondence.
  • Advise on Training Regulations and employment/training contracts.
  • Conduct legal research and liaise with external attorneys and prosecutors.
  • Handle litigation and labour-related matters.
  • Support fine recovery and enforcement of disciplinary conditions.
  • Maintain Discipline Register and PCC Tracking Schedule.
  • Assist with publication of guilty findings and support team members as directed.

3. Governance Support

  • Attend Board and interest group committee meetings as observer.
  • Assist with agenda and minute approvals.
  • Undertake governance-related projects.

4. Organizational Transformation

  • Identify operational efficiencies and support cost containment.
  • Use data analytics to improve decision-making and processes.
  • Leverage digital tools and AI to enhance productivity and service delivery.
  • Support sustainability risk management and integrate into business continuity plans.

Candidate Requirements

Education & Certification

  • Legal qualification (B Proc or LLB)
  • Admitted Attorney

Knowledge Areas

  • Litigation, Administrative Law, Contract Law, Law of Delict, Company Law

Experience

  • Minimum 1 year post-qualification experience
  • High-pressure environment and large caseload handling
  • Civil/criminal litigation experience (advantageous)
  • Excel proficiency and statistical reporting
  • Team management experience (advantageous)
